General Terms of Service
Introduction
These terms and conditions govern your use of Lite Analytics and any services provided through it. Throughout these terms of services, the terms „service“, „services“, “we”, “us” and “our” refer to Lite Analytics and Netmark doo.
Data Processing Agreement (DPA) under the European General Data Protection Regulation (GDPR) forms part of these Terms of Service.
By using our service, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of them, you must not use our service. We may update these Terms of Service in the future. You will be informed through email about any significant changes of our Terms of Service.
Services and website data
Lite Analytics provides web analytics services which analyses web traffic on your website by using a small portion of JavaScript code that you place on your site in order of Lite Analytics to work.
Lite Analytics collects only the necessary data for web analytics respecting the privacy of your site’s users. Lite Analytics does not use cookies. In in our Data policy you can find detail explanation how we collect and store user data.
You own all the rights of your website data, we do not claim any rights on collected website data.
The collected website data will be used only for providing you the analytic reports and dashboard and will not be used for any other purpose or made available to third parties under any conditions.
We as humans can access your data in full discretion to analyze the quality of reports to further improve our service, maintain existing data or to help you with support requests.
Lite Analytics takes many measures to protect your collected website data including encryption, backups and others. We will use reasonable efforts to keep Lite Analytics available at all times. However, we cannot guarantee that the Service will always be available or that it will be bug-free. In case of outage accident, we will do our best to restore the service as soon as possible.
Account terms
To use the service, you must create the user account.
You are responsible for maintaining the confidentiality of your account and password.
You are responsible for any activity that occurs under your account so be careful if you share your account with anybody.
Lite Analytics will not be liable for any loss or damage that may occur because of you not being able to maintain your account and password security.
You must notify us immediately if you suspect any unauthorized use of your account.
The account holder must be a human with a legal name and valid email address. Accounts registered by bots or other automated methods are not permitted.
Lite Analytics may not be used for any illegal activities.
Payments
We offer a 30-day free trial with no credit card required.
After the trial period expires, you will be required to pay for the service. Payment will be charged immediately.
If you choose to pay for the service before your trial period ends, your billing cycle will begin at the end of the 30-day trial period.
Afterwards you will be billed automatically via credit card through our payment provider Paddle according to the plan you have selected (monthly/yearly). If payment provider is unable to charge your credit card, we will let you know. If payment provider can’t charge your card longer that two weeks, your account will be suspended. Two weeks after the suspension, if no payment has been made, your account will be terminated and all your data will be deleted from our servers.
You will not be charged for occasional spikes in traffic that exceed the number of pageviews included in your payment plan. If we notice the constant trend of your traffic exceeding your payment plan, we will contact you to upgrade your billing plan. . If you do not upgrade your plan within two weeks, your account will be suspended due to traffic that exceeds the limits of your billing plan. Two weeks after the suspension, if no upgrade and payment has been made, your account will be terminated and all your data will be deleted from our servers.
In the event of two consecutive months with lower traffic than your current billing plan, you may downgrade your billing plan. We do not guarantee that all your data from the period of higher payment plan will be kept and available if you downgrade your payment plan.
Price modifications
We reserve the rights to change the prices of our service. You will be informed about any permanent price change affecting your account. Permanent price changes will be effective on your next billing period. If you decide not to accept price change affecting your account, you have to cancel the service.
We may introduce temporary discounts for our service. Discounts will not apply on already made payments.
Cancelation and termination
If you cancel the service before the end of your current paid up period, your cancellation will take effect at the end of the current billing cycle, and you will not be charged again. Your dashboard and your reports will be inaccessible after your payment expires. One month after your payment expired, all your website data will be permanently deleted from our servers.
You can choose to your website data or delete your account and all your site stats at any time. All your stats will be permanently deleted immediately when you delete your Lite Analytics account.
We reserve the right to refuse service to anyone for any reason at any time.
We reserve the right to suspend or terminate your account and refuse to provide future service to you for any reason at any time. Reasons for us to suspend or terminate your account are not limited to the following, but most commonly include: Inability to charge your credit card when renewing your subscription, you refusal to upgrade your payment plan despite traffic exceeding your current plan, illegal or suspicious activities noticed on your account.
Intellectual property rights
We own the intellectual property rights in the Lite Analytics and any content provided through it.
You may not modify another website to falsely imply that it is affiliated with Lite Analytics. The service is protected by copyright © rights to Lite Analytics. Lite Analytics logo and content may not be copied, imitated or used, in whole or in part, without the prior written permission of the company or the respective trademark owner. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the service.
We do not claim any intellectual rights on your website data collected by our service or to any content you provide to the service.
Limitations of liability
The service is provided on an “as is” and “as available” basis. We will not be liable to you in any way for any loss or damage of any kind that you may incur as a result of using our service. We will not be liable to you in any way for any loss or damage of any kind that you may incur as a result of any errors or omissions in the service or any content provided through it.
You will indemnify and hold us harmless from and against any claims, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of the Lite Analytics or any services provided through it. These terms and conditions will be governed by and construed in accordance with the laws of the jurisdiction in which our company is located, without giving effect to any principles of conflicts of law.
We may revise these terms and conditions at any time by amending this page.
